TERMS OF ENGAGEMENT
The Fee for the preparation of an expert report including travel time is charged at the rate of £120 per hour, plus disbursements. If the Chairman’s personal attention is required or for particularly complex matters the rate is £140 per hour. In the event the Claimant lives a significant distance that requires extensive travel time, or there is any expectation that time taken to prepare the report exceeds the quotation we will advise you promptly. Mileage will be charged at 50p per mile.
Supplementary work including Meetings of Experts, updates and attendance of the client in general or at Conference will be charged at the same rates described above, plus disbursements.
Legal Services Commission funded cases: We must be advised at the outset whether a case is legally funded and whether prior authority has been made to incur our fees. We will not accept post-instruction advice as a reason for a delay in settling our fee accounts.
Attendance at Court or ET: in the event the report is used for the purposes of litigation, you will be charged £1,200 per working day allocated. If we are given notice that a case is cancelled, postponed or settled within 3 workings days or less before the first hearing day reserved we will charge £600 for the first day allocated or cancelled, and £300 for each subsequent allocated or cancelled day, plus disbursements and mileage. For the avoidance of doubt, if attendance is not required and we are so advised on the morning of the hearing the full daily rate will apply for that and any subsequent days reserved.
THE PATHFINDER PROJECT
The Fee for the preparation of an Assessment including travel time is normally £2,000-00, plus disbursements. However, if the client lives a significant distance, or there is any expectation that time taken to prepare the assessment exceeds this quotation we will advise you promptly. Mileage will be charged at 50p per mile.
Supplementary work, excluding the cost of the Action Plan, will be charged at £1,100-00 per day, or £550-00 per half day plus disbursements. For the avoidance of doubt a minimum half day is charged.
The Action Plan cost is shown within the body of the Assessment and is also subject to disbursements. Case management fees will be billed monthly. It is important to recognise that costs may vary considerably and are entirely dependent on the length and detail of the proposed plan and the amount of time required to support the Claimant in their attempt to return to work. Each case is costed on an individual basis.
Attendance at Case Conference will be charged at £1,100-00 per working day, or £550 per half day, plus disbursements. A minimum half day is charged.
Attendance at Court: in the event the assessment is for the purposes of litigation, attendance and cancellation fees are calculated as per TGA above.
General notes applicable to TGA and Pathfinder:
Accounts are payable in full within 30 days of the invoice date and without deduction, counterclaim or set off in any way whatsoever. Interest at 4% above Barclays Base Rate will accrue on a daily basis from the 31st day.
‘Disbursements’ means all reasonable and appropriate costs and out-of-pocket expenses incurred, including (but not without limitation) travel, refreshments, hotel accommodation, printing and duplicating.
‘Working day’ means a working business day which shall be any day other than a Saturday, Sunday, statutory, bank or public holiday in England and Wales, and is of 8 hours duration.
VAT will be added to all accounts.
Intellectual Property and Moral Rights: Unless otherwise agreed in writing, all rights of ownership in reports, Pathfinder assessments and other original work created by Trevor Gilbert & Associates Limited shall remain vested in Trevor Gilbert & Associates Limited. We assert all of our moral rights.
